A DEFENSE OF HUMEAN PROPERTY THEORY

ABSTRACT Two rival approaches to property rights dominate contemporary political philosophy: Lockean natural and egalitarian theories of distributive justice. This article defends a third approach, which can be traced the work David Hume. Unlike rights, Humean are not grounded in pre-institutional moral entitlements. In contrast begins with highly abstract principles justice, theory starts simple conventions shows how more complex institutions justified against background settled rights. Property allow people coordinate their use scarce resources. For rules serve this function effectively, certain questions must considered settled. Treating existing entitlements as having prima facie validity facilitates cooperation between who disagree about endorse claims that threaten unsettle undermine social cooperation.
